Who do we represent?

We represent employees across all sectors and industries who have been injured because of their employer’s negligence.

Workplace injuries take many forms. Some happen in a moment, such as a fall from a ladder or a collision with moving machinery. Others develop over time, such as a condition caused by years of repetitive movement or prolonged exposure to harmful substances. Whatever the circumstances, if your injury was caused by someone else’s negligence, you may have cause to bring a work accident claim.

Work Accidents

What is a work accident?

Work accidents cover a broad range of circumstances. Some of the most common we deal with include:

  • Slips, trips and falls on wet, cluttered, or uneven surfaces, which can cause fractures, soft tissue damage and head injuries.
  • Manual handling injuries from lifting, pushing, or carrying heavy loads without adequate training or equipment, including back injuries, hernias and torn muscles.
  • Falls from height on construction sites, in warehouses, or during maintenance work, which can result in serious fractures, spinal injuries, or traumatic brain injury.
  • Machinery and equipment accidents caused by inadequate guarding, poor maintenance, or insufficient training, which can lead to crush injuries, amputations, or lacerations.
  • Exposure to harmful substances, such as chemicals, resulting in respiratory conditions.

If your situation does not fit neatly into any of these categories, that does not mean you have no claim. Contact us and we will assess your circumstances carefully.

Can I make a claim?

A successful work accident claim involves proving that your employer failed to meet the standard of care required of them by law and that this failure directly caused your injuries. Employers have wide-ranging obligations under health and safety legislation, relating to matters such as risk assessments, training, and protective equipment. If they breach those obligations and you have a work accident as a result, you may be entitled to compensation.

In Northern Ireland, you generally have three years from the date of the work accident or from the date you first became aware of your injury to bring a claim. Seeking prompt legal advice not only ensures you do not miss this deadline but also means that the evidence you need to prove your case should be readily available.

How much compensation will I receive?

Every claim is different, and the compensation a claimant receives reflects their unique circumstances. Generally speaking, though, compensation in a work accident case is typically made up of several distinct elements:

  • Compensation for personal injuries. This addresses the pain, suffering and long-term effects of your injuries, assessed by reference to their nature and how severely they have affected your life.
  • Loss of earnings. This covers the income you were unable to earn during your recovery. Where your injuries have lasting consequences for your ability to work or career development, you can also include your future losses in your compensation claim.
  • Expenses incurred. These are the costs you have had to meet as a direct result of the accident. They might include the cost of medical treatment, physiotherapy, rehabilitation, and travel to appointments.
  • Compensation for loss of amenities of life. This recognises the ways in which your injuries have prevented you from living life as you did before.

Exceptional client care

Client relationships are at the heart of everything we do at LMK Law. We know that navigating legal proceedings can feel daunting, especially when you are still recovering from an injury. That’s why we go above and beyond to put you at ease, offer reassurance, and support you at every stage of your case.

We provide complete multilingual support in English and Polish, and you are welcome to discuss your case with us in whichever language you feel most at ease.

100% compensation

Solicitors in Northern Ireland cannot offer no win, no fee arrangements. What we do instead is carry out a thorough assessment of the merits of your claim at the outset. Where your claim is successful, the other side’s insurer is responsible for meeting your legal costs, which means your compensation is yours entirely. We will only advise you to proceed where we are genuinely satisfied that there is a sound basis for doing so.

Mental health recovery, supported from the start

The consequences of a workplace accident are not always visible. Alongside physical injuries, many of our clients find themselves struggling with ongoing anxiety, flashbacks, disrupted sleep, recurring nightmares, or a profound reluctance to return to work. These are well-established psychological responses to traumatic events, and they are fully recognised as a legitimate and compensable head of loss within your claim.

We can refer you to specialist psychotherapists for private treatment at no cost to you. NHS waiting lists for psychological support in many parts of Northern Ireland now exceed two years, but through our referral network, treatment can usually begin within weeks. Your therapist will assess which approach is most suitable, whether that is Cognitive Behavioural Therapy, Eye Movement Desensitisation and Reprocessing, or Exposure Therapy, all of which are proven methods for treating trauma. Your mental recovery matters just as much as your physical one, and we will make sure it is treated accordingly.

Specialist barristers and independent medical consultants

We work alongside leading barristers with exceptional advocacy experience and specialist subject matter knowledge. Our network of medical consultants provides independent expert reports that are thorough, well-reasoned, and constructed to withstand robust challenge from the opposing side. These reports play a vital role in establishing the full extent of your injuries and the long-term impact they have had on your life. Throughout every stage of this process, from the initial instruction through to final resolution, you will have experienced legal support behind you at all times.
